We collect only those personal data that are necessary for the performance and handling of our legal services or that you have provided to us voluntarily.
Personal data are any data containing individual information about personal or factual circumstances, for example name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings, and biometric data such as fingerprints. Sensitive data—such as health data or data related to criminal proceedings—may also be included.
As a client or generally as a data subject, you have the right—while respecting attorney-client confidentiality—at any time to obtain information about your stored personal data, their origin, recipients, and the purpose of data processing. You also have the right to rectification, data portability, objection, restriction of processing, and blocking or deletion of incorrect or unlawfully processed data.
If your personal data changes, we kindly ask you to inform us accordingly. You also have the right to revoke your consent to the use of your personal data at any time. Any request for access, deletion, rectification, objection, and/or data transfer (the latter provided it does not involve disproportionate effort) can be sent to the address listed in point 10 of this privacy statement.
If you believe that the processing of your personal data violates applicable data protection law or that your data protection rights have otherwise been infringed, you may file a complaint with the competent supervisory authority. In Austria, this is the Data Protection Authority (Datenschutzbehörde).
The protection of your personal data is ensured through appropriate organizational and technical measures. These precautions particularly serve to protect against unauthorized, unlawful, or accidental access, processing, loss, use, and manipulation.
Despite all efforts to maintain a consistently high standard of care, it cannot be ruled out that information you transmit to us via the internet may be viewed and used by third parties.
Please note that we therefore assume no liability for the disclosure of information due to errors in data transmission not caused by us and/or unauthorized access by third parties (e.g. hacking of email accounts or telephones, interception of faxes).
We will not process the data provided to us for any purposes other than those covered by the engagement agreement, your consent, or other legal bases in accordance with the GDPR. An exception to this is the use of data for statistical purposes, provided the data has been anonymized.
<p>To fulfill your mandate, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitute lawyers, insurance companies, service providers we use and provide data to, etc.), courts, or public authorities. Your data will only be forwarded on the basis of the GDPR, in particular for fulfilling your mandate or based on your prior consent.</p>
<p>Furthermore, we inform you that as part of our legal representation and support, we regularly obtain factual and case-related information about you from third parties.</p>
<p>Some of the above-mentioned recipients of your personal data are located outside your country or process your data there. The level of data protection in other countries may not be equivalent to that in Austria. However, we only transfer your personal data to countries that the EU Commission has determined to have an adequate level of data protection, or we take measures to ensure that all recipients provide an adequate level of data protection, including by concluding Standard Contractual Clauses (2010/87/EC and/or 2004/915/EC).</p>
We make every effort to ensure that data breaches are detected at an early stage and, if necessary, reported without delay to you and/or the competent supervisory authority, including details of the categories of data affected.
We will not retain data longer than necessary for fulfilling our contractual or legal obligations and for defending against potential liability claims.
